SMS Privacy Policy

This Privacy Policy explains how Contravariant, LLC ("Contravariant," "we," "us," or "our") collects, uses, discloses, and protects information in connection with our SMS text message notification program (the "Program"). It applies specifically to information collected through the Program and supplements our general Privacy Policy.

1. Information We Collect

In connection with the Program, we collect:

• Mobile phone number
• Name (if provided during opt-in)
• Opt-in/opt-out status and the date, time, and method of consent
• The content and delivery status of messages sent to and received from you
• Any information you voluntarily provide in a reply message

2. How We Use Your Information

We use the information collected through the Program to:

• Send the SMS notifications and alerts you have opted in to receive
• Confirm and record your consent and opt-out status, as required by law
• Respond to HELP requests and other inbound messages
• Maintain records for legal, regulatory, and compliance purposes (e.g., TCPA and carrier requirements)
• Improve and, if expanded, scale the Program to additional subscribers

3. No Sharing of Mobile Opt-In Data for Marketing

No mobile information, including phone numbers and consent records collected through the Program, will be shared with third parties or affiliates for their marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties for any purpose.

4. Other Disclosure of Information

We may share information collected through the Program with:

• Service providers who deliver SMS messages on our behalf (e.g., SMS gateway or carrier platform providers), solely to operate the Program
• Law enforcement or regulators, if required to comply with a legal obligation, subpoena, or court order
• A successor entity in connection with a merger, acquisition, or sale of assets, subject to this Policy or a materially similar one

We do not sell mobile phone numbers or SMS opt-in data.

5. Data Retention

We retain phone numbers, consent records, and message logs for as long as necessary to operate the Program, comply with legal and carrier recordkeeping requirements, and resolve disputes. Opt-out requests and the fact of consent/withdrawal are retained even after a number is unsubscribed, to ensure we do not re-contact opted-out numbers.

• Opt out: Reply STOP to any message at any time to stop receiving SMS messages from the Program.
• Help: Reply HELP to any message for assistance.
• Access/deletion: You may request access to, correction of, or deletion of the personal information we hold about you in connection with the Program by contacting us using the information in Section 9. We will respond within a reasonable time and as required by applicable law.

7. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect information collected through the Program from unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

The Program is not directed to individuals under 18, and we do not knowingly collect information from children through the Program.
